Exclusive Listing AgreementI, ____________________________ hereby appoint Billy Oliver’s Boat Brokerage as my Exclusive Broker, for the vessel _____________________ for one year; and authorize him to accept a deposit to be applied to the purchase price of the sold boat. I certify that I am the Owner of the above vessel, have the right to sell, and that all information given by me is correct. I understand and agree: 1. To allow the vessel to be shown at reasonable times. 2. To verify to Billy Oliver’s Boat Brokerage that the vessel will be free of any debts, liens and encumbrances at the time of the sale. 3. To furnish registration, documentation or proof of ownership at the time of listing. 4. By giving Billy Oliver’s Boat Brokerage exclusive rights to the sale of the vessel, it will handle all phases of the sale and be given its full 10% commission even if the buyer is brought forth by the Owner or another brokerage ($2000.00 minimum commission). 5. Billy Oliver’s Boat Brokerage reserves the right to determine how the 10% commission will be shared with another brokerage based on their involvement in the individual sale. 6. Owner further agrees to pay the same fee of ten percent (10%) should he/she at any time within one (1) year after termination of this Agreement sell, trade, exchange or otherwise transfer or convey the Vessel in any manner to any party to whom the Broker or one of its sub-listed brokers has provided information concerning, or shown, the Vessel during the term of this Agreement. 7. To notify Billy Oliver’s Boat Brokerage of any and all inquiries you receive within a three day period of them being made. 8. That the efforts put forward by Billy Oliver’s Boat Brokerage in listing, marketing and closing on the vessel are time-consuming and costly, making the commission reasonable and fair compensation. Billy Oliver Boat Brokerage maintains an escrow account, in which the 10% earnest money from the buyer is deposited. This protects both the buyer’s and seller's investment by ensuring that all money stays in a separate escrow account. 9. In the event of a dispute regarding the listing of the vessel the parties hereby agree to use all reasonable efforts to resolve the matter prior to filing a civil action. Disputes shall be resolved in the state of Massachusetts or Maine. All attorney’s fees regarding any dispute will be the sole responsibility of the seller.
